Welcome to BurgerShop. These Terms of Service (“Terms”) govern your access to and use of the BurgerShop platform, websites, applications, tools, templates, integrations, and related services (collectively, the “Services”).
By creating an account, accessing, or using the Services, you agree to be bound by these Terms. If you do not agree, you must not access or use the Services.
About BurgerShop
BurgerShop provides a subscription-based commerce platform and related services for sellers, including store-building tools, templates, policy-oriented infrastructure, POD-related integrations, AI-assisted tools, and optional service add-ons.
The Services may include, depending on your plan or purchase:
- store templates and store-building features
- Google-ready store components
- integrations for fulfillment, personalization, and payment
- AI-assisted tools and automation features
- optional service packages such as audits, setup, recovery, or other consulting and support services
Certain features may only be available on specific plans, add-ons, beta releases, custom orders, or partner integrations.
Eligibility and Account Registration
To use the Services, you must:
- be at least 18 years old or the age of majority in your jurisdiction
- have the legal capacity to enter into a binding agreement
- provide accurate, complete, and up-to-date registration information
If you create an account on behalf of a company or other legal entity, you represent that you have authority to bind that entity to these Terms.
You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.
Store Owner; Staff Access
The person or legal entity that registers for the account is the “Store Owner.” The Store Owner is responsible for the account, all content, all store activity, all billing obligations, and all actions taken by staff members, contractors, or any other users granted access to the account
BurgerShop may allow the Store Owner to create additional user or staff access depending on the applicable plan. The Store Owner remains fully responsible for those users and their compliance with these Terms.
Your Responsibilities
You are responsible for your store, your products, your content, and your relationship with your customers.
You acknowledge and agree that you are responsible for:
- the accuracy, legality, and completeness of your store content
- product listings, descriptions, images, pricing, and promotions
- customer service, refunds, returns, disputes, and chargebacks
- taxes, duties, and legal disclosures
- compliance with applicable laws, regulations, and third-party rights
- compliance with advertising, marketplace, and payment provider requirements
- any use of third-party suppliers, POD partners, or other service providers connected to your business.
You must publish and maintain clear, accurate, and publicly accessible business information and customer-facing policies on your store, including, where applicable:
- contact information
- terms of service
- privacy policy
- shipping policy
- refund / return / exchange policy
These pages should be consistent with your actual operations and with the information shown during checkout.
Nature of the Services
BurgerShop is a technology platform. Unless expressly stated otherwise in a separate written agreement, BurgerShop is not:
- the seller of the products listed on your store
- the merchant of record for your customer transactions
- a party to the contract of sale between you and your customers or
Any sale made through your store is directly between you and your customer.
Plans, Fees, and Billing
BurgerShop offers subscription plans and may also offer add-ons, service packages, partner features, or custom services. Fees may vary depending on:
- your selected subscription plan
- store count, user count, usage level, or feature access
- optional add-ons or service packages
- third-party services or partner integrations you choose to use
All fees are charged based on the pricing page, service order, proposal, invoice, or custom agreement in effect at the time of purchase.
Unless otherwise stated:
- subscription fees are billed in advance on a recurring basis
- add-ons and service fees may be billed one-time, monthly, usage-based, or under a separate scope of work
- all fees are exclusive of taxes, duties, bank charges, and similar governmental or transactional charges and
- you are responsible for all applicable taxes arising from your use of the Services or your business activities
You must keep a valid payment method on file. By using the Services, you authorize BurgerShop to charge the applicable fees to your selected payment method.
If payment fails, BurgerShop may retry the charge and may suspend, limit, or terminate access to some or all of the Services until all outstanding amounts are paid.
Subscription Policy and No-Refund Rule
BurgerShop generally does not provide refunds for subscription fees, plan fees, add-ons, or service fees once charged.
This means:
- subscription fees are generally non-refundable
- no prorated refund is provided for unused time in a billing cycle
- cancellation during an active billing period does not entitle you to a refund for that period and
- termination of your account does not entitle you to the return of previously paid fees, except where required by law or expressly approved by BurgerShop in writing
Exceptional Billing Review
Although BurgerShop follows a general no-refund policy, we may review certain requests on a case-by-case basis in limited circumstances, such as:
- duplicate charges
- clearly unauthorized billing
- confirmed billing errors caused by BurgerShop or
- exceptional technical or operational circumstances that BurgerShop determines warrant review
A review does not guarantee a refund, credit, or adjustment. Any exception is granted at BurgerShop’s sole discretion unless otherwise required by law
To request a billing review, the Store Owner must contact BurgerShop Support and provide sufficient supporting information, including account details, invoice details, and a description of the issue.
Third-Party Services and Integrations
The Services may connect with or reference third-party tools, payment providers, fulfillment partners, personalization apps, domains, analytics tools, advertising channels, or other external services
Your use of any third-party service is governed by that third party’s own terms, policies, and fees. BurgerShop is not responsible for third-party services, third-party downtime, third-party fees, or disputes between you and any third-party provider
BurgerShop may remove, replace, disable, or stop supporting third-party integrations at any time.
Content, Materials, and Intellectual Property
You retain ownership of the materials, content, trademarks, product information, designs, and other assets that you lawfully upload or submit to the Services (“Your Materials”).
You grant BurgerShop a non-exclusive, worldwide, royalty-free license to host, display, process, reproduce, adapt, and use Your Materials solely as necessary to:
- provide and maintain the Services
- operate your store and connected features
- improve product functionality and support
- troubleshoot, secure, and monitor the Services and
- perform obligations under these Terms
You represent and warrant that you have all rights, permissions, and authorizations necessary to use and submit Your Materials.
You must not upload, publish, sell, or distribute any content or products that:
- infringe copyrights, trademarks, publicity rights, or other intellectual property rights
- are deceptive, unlawful, defamatory, abusive, or fraudulent
- violate advertising, payment, or marketplace rules or
- create material legal, trust, or policy risk for BurgerShop or its partners
BurgerShop may remove content, disable listings, or suspend accounts where it reasonably believes a violation has occurred.
Acceptable Use
You agree not to:
- misuse, disrupt, reverse engineer, or interfere with the Services
- access the Services using unauthorized automation, scraping, or abuse techniques
- bypass technical limitations or security controls
- use the Services for unlawful, infringing, deceptive, or harmful conduct or
- submit false business, billing, identity, or compliance information
Suspension and Termination
You may cancel your account or subscription at any time. Cancellation will generally take effect at the end of the current billing cycle unless otherwise stated in a separate order or service agreement.
BurgerShop may suspend, restrict, or terminate your access to the Services at any time, with or without prior notice, if:
- you violate these Terms
- you fail to pay fees when due
- your use creates fraud, abuse, legal, trust, reputational, or security risk
- required third-party services become unavailable or
- BurgerShop is required to do so by law, policy, or partner obligations
Upon termination:
- your access to the Services may immediately end
- your store or features may be disabled
- you remain responsible for all accrued obligations and outstanding fees and
- previously paid fees remain non-refundable except where required by law or expressly approved in writing
Privacy and Data Protection
BurgerShop’s collection, use, and processing of personal information is governed by the BurgerShop Privacy Policy
You are responsible for ensuring that your own store, customer communications, and business operations comply with applicable privacy, consumer protection, and data protection laws
Service Changes
BurgerShop may update, improve, modify, suspend, or discontinue any part of the Services at any time. We may also change plans, features, limits, or pricing from time to time
Where appropriate, BurgerShop will provide notice of material changes through the platform, by email, or by updating the relevant legal page
Disclaimers
The Services are provided on an “as is” and “as available” basis to the fullest extent permitted by law.
BurgerShop does not guarantee that:
- the Services will be uninterrupted, error-free, or available at all times
- any store, listing, feed, GMC account, ad account, or campaign will be approved or remain approved
- any seller will achieve a particular revenue, traffic, conversion, or policy outcome or
- any recommendation, AI output, template, checklist, or support guidance will be sufficient for legal or platform compliance in every case
Limitation of Liability
To the fullest extent permitted by law, BurgerShop will not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, including loss of profits, revenue, data, goodwill, customers, or business opportunities arising from or related to your use of the Services
To the maximum extent permitted by law, BurgerShop’s total liability for any claim arising out of or relating to the Services will not exceed the total amount you paid to BurgerShop for the specific Service giving rise to the claim during the three (3) months preceding the event giving rise to liability.
Indemnification
You agree to indemnify and hold harmless BurgerShop, its affiliates, team members, contractors, and partners from any claim, demand, liability, damage, loss, cost, or expense arising out of or related to:
- your store, products, or business activities
- Your Materials
- your breach of these Terms or
- your violation of any law or third-party rights
